Terms of Service

1. Parties

These Terms of Service ("Agreement") are between Black Terminal Consulting ("BTC," "we," "us") and the individual or business that subscribes to our services ("Client," "you"). By completing payment you confirm you have read and agree to these terms.

2. Services

Your subscription includes:

• Custom website — a professionally designed, mobile-friendly website built for your business.
• Domain registration — one .com domain registered and maintained on your behalf for the duration of the agreement.
• Hosting & SSL — secure hosting, HTTPS certificate, and regular backups.
• Initial setup — one session to incorporate your photos, business information, hours, and services.
• Annual content update — one content refresh per subscription year. Must be requested within the year; unused updates do not roll over.

Add-on services (additional pages, SEO, booking integrations, etc.) are available separately and will be agreed upon in writing before work begins.

3. Term

Your subscription begins on the date of first payment and runs for a minimum of two (2) years. After the initial two-year term, the subscription automatically continues on a month-to-month basis at the same rate until cancelled.

4. Payment

• Monthly plan: $10.00/month, billed on the same day each month via Stripe.
• Annual plan: $100.00/year, billed once per year via Stripe. Equivalent to 2 months free vs. monthly.
• All payments are processed securely by Stripe. BTC never stores your card details.
• If a payment fails, we will notify you and retry. Service may be suspended after 15 days of non-payment.

5. Cancellation

You may cancel at any time by contacting us at 678-480-4705 or zlr@blackterminalconsulting.com with 30 days written notice.

Because this is a two-year minimum commitment, early cancellation during the initial term may result in the remaining balance of your two-year obligation becoming due. We will always work with you to find a fair resolution.

BTC may terminate service immediately for non-payment exceeding 30 days or if the site is used for unlawful purposes.

6. Your Domain

The domain we register belongs to you. Upon cancellation or end of the agreement, we will transfer the domain to you at no cost provided all balances are paid in full. Transfer typically takes 3–5 business days.

7. Content & Your Responsibilities

• You are responsible for providing accurate business information, photos, and other content.
• You confirm you have the right to use all photos and materials you provide to us.
• You agree not to use your website for any unlawful, harmful, or misleading purpose.
• Keep your contact information and payment method current.

8. Intellectual Property

Website design, code, and templates created by BTC remain the intellectual property of Black Terminal Consulting. You receive a license to use the website while your subscription is active. Content you provide (your photos, text, logo) remains yours.

9. Limitation of Liability

We work hard to keep your site online and secure, but we cannot guarantee 100% uptime. BTC is not liable for losses caused by hosting outages, third-party service failures, hacking, or events beyond our control. Our total liability in any dispute shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Changes to These Terms

We may update these terms from time to time. We will notify you by email at least 30 days before any material changes take effect. Continued use of the service after that date constitutes acceptance.

11. Governing Law

This agreement is governed by the laws of the State of Georgia. Any disputes shall be resolved in Gwinnett County, Georgia.

12. Entire Agreement

These terms, along with any signed add-on agreements, constitute the entire agreement between BTC and the Client. Questions? Call or text 678-480-4705 — we're happy to walk through anything before you subscribe.
